In Brief
This case concerns the applicability of pharmacy registration laws in newly formed States after bifurcation of parent States. When Bihar was reorganised into Bihar and Jharkhand in 2000, the question arose whether Jharkhand could prepare its own First Register of Pharmacists or must use Bihar's pre-existing register. The Supreme Court held that the First Register prepared by Bihar, bifurcated by the pharmacists' residential addresses, constitutes Jharkhand's First Register. New States cannot re-prepare First Registers. Subsequent registrations must comply with Education Regulations. This principle applies identically to Chhattisgarh after Madhya Pradesh's bifurcation. Laws of parent States continue in newly formed States until legislatively modified.
