RB DEALERS PRIVATE LIMITED vs THE METRO RAILWAY(SERVICE THROUGH THE GENERAL MANAGER)

Bench: 3 — Arun Mishra, S. Abdul Nazeer, M.R. Shah

In Brief

RB Dealers Private Limited sought special leave to appeal a High Court decision concerning compensation for land acquired for metro railway construction under the 2013 Land Acquisition Act. The key dispute was whether solatium (compensation bonus) should be calculated on market value plus assets alone, or also include an additional 12% per annum amount payable separately. The Supreme Court held that the solatium must be calculated only on the market value and assets (the compensation amount), excluding the separate 12% per annum addition. The final award comprises three independent components: compensation amount, solatium (100% of compensation), and the 12% per annum amount. The petitions were dismissed.
