Dr. Prabhugouda, an Associate Professor at an affiliated college (J.S.S. College), was appointed as Associate Professor at Karnataka University in October 2013 and later promoted to Professor with effect from that date. He challenged this, claiming the promotion should be effective from January 2009 when he completed three years of service in the affiliated college. The High Court allowed his petition, treating service in affiliated colleges the same as service in university colleges. The Supreme Court reversed this, holding that under the University's Career Advancement Scheme statute, 'colleges' means only constituent colleges, not affiliated colleges. The effective date of promotion must be from when the teacher entered University service, though prior service may be counted for eligibility. The appeal was allowed and the High Court's judgment was quashed."
