Roppen Transportation Services Pvt. Ltd. sought a license to operate a two- and three-wheeler aggregator service in Maharashtra. The Road Transport Officer rejected the application citing non-compliance with the Motor Vehicle Aggregator Guidelines 2020. The State then issued a notification prohibiting non-transport vehicle pooling. The Supreme Court held that the Central Guidelines are persuasive, not mandatory, and the State retains discretion over licensing. The Court dismissed the Article 32 petitions, directing petitioners to challenge the notification under Article 226 before the High Court. The Court directed the State's Committee to decide by 15 March 2023 and the State Government to issue a final decision by 31 March 2023.
