Sachichidanand Prasad & Ors vs General Manager, National Thermal Power Corpn. & Anr

Bench: 2 — Kurian

In Brief

The appellants challenged the land compensation fixed by the Collector at Rs. 357/- per decimal for their property acquired for the National Thermal Power Corporation. The Reference Court raised this to Rs. 1988/-, but the High Court found this erroneous and set it aside. The Supreme Court resolved the dispute by fixing compensation at Rs. 480/- per decimal—the rate already settled in comparable neighbouring cases—along with statutory benefits. The Court granted the appellants one month to prove if higher rates had been agreed elsewhere, in which case those rates would apply instead, ensuring fairness and consistency across similar acquisitions."
