Samaul Sk was convicted under Section 498A IPC (dowry demand and cruelty) and sentenced to three years' rigorous imprisonment. He appealed, seeking the benefit of the Probation of Offenders Act, which was denied. The Supreme Court upheld the denial of probation but allowed his appeal conditionally. Since he had already undergone seven months and offered to pay compensation of Rs. 3 lakh to his wife and children, the Court reduced his sentence to the period undergone, subject to timely deposit of the compensation amount. Rs. 2 lakh would be released to the wife, while Rs. 1 lakh would be held in fixed deposits for the children, to be released upon their attaining age 21."
