Appellants from Uttar Pradesh were appointed as Civil Judges in Bihar relying on Scheduled Caste reservation. A writ petition challenged this, and the High Court set aside their appointment, holding they were not entitled to SC reservation having migrated to another state. The Supreme Court upheld the High Court's reasoning (based on settled constitutional law that reservation benefits do not transfer across states), but allowed the appellants a final opportunity to appear in the next judicial recruitment examination in the open merit category in relaxation of age bar. The Court extended the same relief to the original writ petitioner and intervenor to prevent discrimination. The appeal was disposed of on this modified basis.
