In Brief
Sant Dnyaneshwar Shikshan Sansthan challenged the High Court's decision quashing a Government Resolution that transferred recognition of a derecognized Ashram School in Jalgaon to the appellant organization in Sangli (400 km away). The Supreme Court held that recognition of a derecognized school cannot be transferred like a business licence; once withdrawn, recognition ceases to exist. The Court affirmed the High Court's decision, finding the transfer violated the 2007 Resolution limiting transfers to 10 km and specific grounds. However, to protect enrolled students, the Court allowed the appellant's school to continue until 2019-2020 and directed the State to follow transparent procedures for future school transfers, with back-wages and continuous service credit for displaced employees."
