A laboratory attendant appointed to a school with official approval was later promoted to junior clerk. When a new body of trustees took over and prevented him from working, the education officer ordered his reinstatement. However, the new trustees later terminated his service. The employee filed a delayed appeal before the School Tribunal with a condonation application. The Tribunal condoned the delay, but the High Court set it aside. The Supreme Court held that the employee deserved the opportunity to challenge the termination before the Tribunal, as his appointment and promotion had been duly approved by the district education officer, and his repeated correspondence showed he was not negligent. The Court set aside the High Court's order and restored the appeals before the Tribunal for disposal.
