Sant Lal Gupta & Ors vs Umesh Kumar Jain & Ors

Bench: 2 — Uday Umesh Lalit

In Brief

A cooperative housing society dispute involved 14 members expelled in 1987 whose expulsion was set aside by the Supreme Court in 2010. However, 12 new members had been inducted and occupied the reserved apartments. When ordered to vacate and failing to comply, a contempt petition was filed. Rather than simply enforce vacation, the Court allowed new construction of 18 apartments within available FAR. The wrongfully inducted members were ordered to vacate by August 2019 but offered re-membership by depositing Rs. 10 lakhs each and contributing to the new building, balancing the rights of all parties involved."
