A worker was severely injured in a motor accident in 2013, requiring amputation of his right leg above the knee. He was permanently employed as a gunman for a hotel. The Motor Accident Claims Tribunal awarded compensation of ₹34,29,800 based on 100% loss of earning capacity. The High Court, without disputing the injury or other findings, reduced compensation to ₹28,43,000 by assessing loss of earning capacity at only 80%. The Supreme Court allowed the appeal, holding that functional disability must match the job's requirements: a legless person cannot work as a gunman. At age 50, finding alternative employment was unrealistic. The Court restored the Tribunal's award and corrected a calculation error in the High Court's judgment.
