Sarv Jan Kalyan Sewa Samiti challenged the National Green Tribunal's order disposing of a pending Original Application concerning a land-exchange proposal without hearing the appellant's objections. The Supreme Court had previously (8 February 2019) directed that the OA remain pending so the appellant could pursue remedies. The NGT ignored this direction and dismissed the OA. The Supreme Court held that the NGT was bound to comply with its prior order. The Court set aside the NGT's order and restored the OA to its file, directing that the appellant be permitted to present objections while allowing the parallel administrative process to continue."
