Sarv Jan Kalyan Sewa Samiti challenged an NGT order dated 11 February 2019 that disposed of an Original Application (OA 124 of 2017) without allowing the appellant to raise objections to a proposed land exchange affecting forest land. The Supreme Court had previously (8 February 2019) directed that the OA remain pending and not obstruct the appellant from pursuing remedies on pending objections. The NGT, having misunderstood or disregarded this direction, closed the proceedings. The Supreme Court held the NGT's action indefensible, as it violated the Court's earlier mandate. The impugned order was set aside and the OA restored to the NGT file for proper adjudication.
