Sarv Jan Kalyan Sewa Samiti vs Union of India & Ors

Bench: 2 — Dhananjaya Y. Chandrachud

In Brief

Sarv Jan Kalyan Sewa Samiti challenged an NGT order of 11 February 2019 that disposed of pending proceedings without hearing the appellant's objections to a proposed land exchange. The Supreme Court had earlier (8 February 2019) ordered the NGT to keep those proceedings alive while allowing parallel administrative consideration. The NGT ignored this directive and closed the case. The Supreme Court held the NGT's action indefensible and duty-bound to follow judicial orders. The impugned order was set aside, and the Original Application was restored to the NGT's file so the appellant could present its objections in accordance with the Supreme Court's earlier order.
