Savatram Rampratap Mills vs Radheyshyam s/o Laxminarayan Goenka (D) Thr. LRs. & Anr

Bench: 2 — Abhay Manohar Sapre

In Brief

The Supreme Court dismissed a civil appeal concerning the jurisdiction of an Estate Officer under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971. The appellant, a National Textile Corporation mill at Akola, sought to evict unauthorized occupants but issued notices requiring appearance at Mumbai instead of Akola. The Court upheld the High Court's decision quashing the notices, holding that Section 3(b) of the Act restricts the Estate Officer's jurisdiction to the local limits specified in the official notification. Since the premises and cause of action were at Akola, proceedings had to be initiated there. The Court allowed the appellant to issue fresh notices and conduct proceedings properly at Akola."
