The appellants challenged a notice issued under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 seeking their eviction from a Pune property. The Supreme Court held that when a person in occupation raises a bona fide dispute regarding ownership rights, the Government cannot invoke summary eviction procedures under the Act. Instead, the proper remedy is to file a civil suit through ordinary courts. Since the appellants had a long-standing ownership dispute with the Union of India over the property, the summary procedure was inappropriate. The Court quashed the eviction notice and reaffirmed that complicated questions of title cannot be decided through summary processes.
