Two nurses qualified in General Midwifery and registered with the Maharashtra Nursing Council sought a special written examination for staff nurse positions. The respondents contended the petitioners were ineligible because they were not in continuous service until the examination date. The Court upheld a prior divisional bench decision (WP 11645/2019), holding that the government resolution of 28-06-2019 required only that candidates were appointed between 01-01-2012 to 15-04-2015 and working until the cut-off date (15-04-2015), not continuous service thereafter. The Court found the respondents' restrictive interpretation untenable and ordered a fresh special written examination within two months.
