Secretary, Tamilnadu Public Service Commission vs A.B. Natarajan & Ors. etc

Bench: 2 — Anil R. Dave

In Brief

Tamil Nadu Public Service Commission and selected candidates sought review of a Supreme Court judgment that had confirmed the termination of their services for alleged irregularities in examination conducted by the TNPSC. The Court allowed the review petitions, directing continuation of services for those who had worked efficiently for over 7-8 years, primarily because they were given insufficient time (only 2-4 March 2011) to represent their case before the High Court. The Court exercised its power under Article 142, finding that procedural fairness had been compromised and that the harshness of termination was unjustified given the candidates' unblemished service record."
