In Brief
In this maintenance appeal, the Supreme Court reviewed a High Court decision that reduced maintenance from Rs. 25,000 to Rs. 12,000 per month for a wife and son, on grounds the wife was capable of earning. The Court held that mere capacity to earn—without proof of actual employment—cannot justify reducing maintenance. Given the respondent-husband's substantial income (over Rs. 80,000 monthly as a Senior Lecturer) and ownership of 26 acres of irrigated land, the Court affirmed the Family Court's original award of Rs. 15,000 for the wife and Rs. 10,000 for the son, subject to maintenance for the son ceasing at majority."
