In Brief
A wife filed a transfer petition to move her case for restitution of conjugal rights and to seek visitation rights after her husband granted her triple talak (Islamic divorce). The Supreme Court found the transfer petition had become infructuous because the triple talak ended the marriage, making the restitution petition moot. Rather than adjudicate visitation rights in this petition, the Court directed the wife to approach the Family Court at Kashipur, Uttarakhand. The Court requested the Family Court to decide the matter promptly, the husband to cooperate, and the District Judge to provide legal aid to the wife. The petition was disposed accordingly.
