Shakti Prasad Bhatt etc. etc vs State of Uttarakhand and Ors. etc

Bench: 2 — Sanjay Kumar, Alok Aradhe

In Brief

Kurk Amins were appointed by the Uttar Pradesh Government to recover cooperative society dues. After years of litigation, the Supreme Court and High Courts established they were Government servants entitled to civil service benefits. When Uttar Pradesh was reorganised into Uttarakhand in 2000, some Kurk Amins were allocated there. The Uttarakhand High Court Division Bench limited their service credit to post-2000, denying benefits for pre-2000 service. The Supreme Court reversed this, holding that past services cannot be erased by State bifurcation. Kurk Amins are entitled to count all prior service for pension, promotion, and post-retiral benefits without temporal limitation. The appeals were allowed."]
