SHAMSHER SINGH SANDHU vs UNION OF INDIA

Bench: 2 — D.Y. Chandrachud, Ajay Rastogi

In Brief

Shamsher Singh Sandhu, a Deputy Inspector General in the CRPF, was promoted to Inspector General (IG) in 2012 based on a medical report from Dr Ram Manohar Lohia Hospital. However, subsequent Medical Boards categorized him as unfit for the rank, and his promotion was withdrawn. The reversion was passed without notice or hearing. The Supreme Court held that although the Medical Board reports did not support IG rank, equity demanded that retiral dues be computed on the basis that he retired as an IG, since he had worked in that rank for nearly four years under interim court orders. However, the Court declined to direct further consideration for promotion to Additional DGP rank."
