Shamsher Singh Sandhu vs Union of India and Others

Bench: 2 — Dr. Dhananjaya Y Chandrachud, Ajay Rastogi

In Brief

The appellant, a CRPF officer, sought promotion to Inspector General of Police rank but was declared medically unfit by multiple Medical Boards. After being briefly promoted, he was reverted to Deputy Inspector General without notice or hearing. The High Court rejected his petition, but the Supreme Court's interim order on the SLP directed status quo, allowing him to work as IG until retirement in 2016. The Supreme Court held that while substantive promotion could not be granted due to adverse final medical reports, justice required that his retiral dues be computed as an IG rank officer since he worked in that rank for four years under the Court's interim order. No further promotion consideration to Additional DGP rank was granted.
