In Brief
Sher Singh Yadav and other villagers appealed against a Gram Panchayat Resolution exchanging village common land with developers. The Supreme Court upheld the exchange, finding that the Panchayat had complied with all three statutory conditions under Rule 5 of the Punjab Village Common Lands (Regulation) Rules, 1964: forming the opinion that exchange would benefit villagers, obtaining Government approval, and ensuring equivalent land value. Although the appellants claimed disparity in land values, they presented no documentary evidence. As the exchange had been completed, constructions undertaken, and the Panchayat subsequently ceased to exist (replaced by a Municipal Corporation), restoration was impossible. The Court dismissed the appeals.
