Three accused persons were convicted under IPC s. 302/34 for a criminal offence. While Khelan Yadav's SLP was dismissed as lacking merit, the SLP of Shiv Prasad and Ravi Kumar was granted. Both appellants claimed they were juveniles at the time of the incident, which an inquiry by a Sessions Judge confirmed. Although the matter should normally go to the Juvenile Justice Board, since both had already served over three years in prison, the Supreme Court found no useful purpose in further proceedings. The appeal was allowed and both appellants were directed to be released.
