Shiv Prasad @ Shiva @ Tillu and Another vs State of Madhya Pradesh (Now Chhattisgarh)

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Three men were convicted under IPC section 302 (murder) by the trial court; the High Court upheld their convictions. Two of them—Shiv Prasad and Ravi Kumar—claimed they were juveniles at the time of the offence. The Supreme Court ordered an inquiry, which confirmed their juvenile status. Since they had already served over three years in prison, the Court held that referral to the Juvenile Justice Board would serve no purpose and directed their immediate release. The third accused's petition was dismissed without grant of leave."
