Shiv Ram and his co-accused Sita Ram faced charges under the Narcotic Drugs and Psychotropic Substances Act, 1985 for drug trafficking. The trial court acquitted both. However, when the State appealed, the High Court acquitted the co-accused but convicted Shiv Ram to 20 years imprisonment. The Supreme Court found that the High Court had failed to adequately address the trial court's reasons for acquittal before convicting the appellant. Consequently, the Court released Shiv Ram on bail pending appeal and listed the case for final hearing.
