The appellant sought enhanced compensation for motor accident injuries. He was a painter with 24.3% whole body disability. The Tribunal had assessed his monthly income at Rs.5,500 and the High Court at Rs.6,500, though the appellant claimed Rs.15,000–16,500. Since there was no serious dispute about his occupation or the reasonableness of his claim, the Supreme Court held that his self-estimate should be accepted. The Court assessed his income at Rs.15,000 per month, deducted one-third for personal expenses, and assessed assessable income at Rs.10,000 per month for compensation purposes. The appeal was allowed.
