Two senior doctors employed by Madhya Pradesh went to Zanzibar in 1975 without obtaining prior permission and worked there until 1991. When they sought reinstatement, the State delayed issuing posting orders despite tribunal directions until 1996. The High Court allowed their reinstatement but only from 1996 with reduced pay. The Supreme Court held the appellants should be deemed in service from their 1991 joining report, with full salary from that date. The period abroad (1975–1991) counted toward pension only, without salary. The State was held responsible for the unjust delay in issuing posting orders.
