Shree Ram Urban Infrastructure Ltd. & Anr vs State of Maharashtra & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Shree Ram Urban Infrastructure challenged a decision regarding a multi-storey public parking lot project in Maharashtra. The Government had granted in-principle approval and deemed permission had accrued under planning law. Though completed since 2012, the facility remained unused, prompting a Public Interest Litigation questioning its commencement certificate. The Supreme Court held that the project had valid deemed permission under the Maharashtra Regional and Town Planning Act and did not require regularisation. The PIL's contentions lacked substance, and the Municipal Commissioner's determination of refuge area was upheld. The appeals were dismissed as the project had complied with all requisite statutory procedures."
