A developer was directed to refund Rs.5,91,150 with 18% annual interest to complainants, pay Rs.1,00,000 as compensation and Rs.50,000 as penal damages, and deposit Rs.10 lakhs as penalty in the Consumer Welfare Fund. On appeal, the Supreme Court upheld the refund and compensation orders but relieved the developer of the Rs.10 lakh penalty. Instead, the Court directed Rs.10 lakhs from the deposited amounts be given to complainants towards the interest component, and remaining deposits returned to the appellant. The decision balanced justice between the parties in this consumer protection dispute."
