In this civil appeal, the appellants challenged the appointment of the respondent as Project Engineer (Electrical) on deputation with subsequent absorption at NOIDA. The Supreme Court held that the Authority has the power to absorb a deputationist under the U.P. Industrial Development Act 1976 and NOIDA Service Regulations 1981, whether expressly or by necessary implication. At the time of the respondent's appointment and absorption, the appellants lacked the required 8 years of service in the Assistant Project Engineer post and thus were ineligible for promotion. The Court dismissed the appeal, finding no merit in the challenge to the respondent's appointment.
