A civil service employee challenged the High Court's dismissal of his writ petition seeking promotion within the U.P. Development Authorities. The Supreme Court held that while the employee's initial selection without formal concurrence of the Public Service Commission was procedurally irregular, it was not illegal since he had competed fairly and been selected transparently. The Court ruled that procedural defects do not invalidate substantive appointments and that the employee became entitled to promotion upon acquiring requisite qualifications when the promotion notification was issued. The appeal was allowed and promotion was granted, either from the notification date or from when junior officers were promoted.
