Shyam Sharma vs State of Madhya Pradesh and Anr

Bench: 2 — S. Abdul Nazeer

In Brief

Shyam Sharma was convicted under Section 307 IPC (attempt to cause death) for firing a gunshot that injured Manjeet Singh on the shoulder. The High Court affirmed the Sessions Judge's conviction and three-year sentence. On appeal, the Supreme Court found that the two independent witnesses had turned hostile and the victim was shot without premeditation on a non-vital body part. Lacking proof of intent to kill, the Court reduced the conviction to Section 324 IPC (causing hurt by dangerous weapon) and reduced the sentence to four months already undergone by the appellant during trial.
