In Brief
A motorcycle owner was involved in a fatal accident in March 2010. The Motor Accident Claims Tribunal found the driver (the owner) drove recklessly without a valid licence and directed the insurance company to pay compensation but recover it from the owner. The owner challenged this, arguing the insurer should remain liable. The Supreme Court upheld the lower courts' decision, finding the owner failed to exercise reasonable care by producing a fake licence and failing to renew an expired licence within the legally prescribed 30-day period. The Court dismissed the appeal, holding the insurer could recover the compensation from the negligent owner.
