In Brief
A 2019 Supreme Court case addressed the rights of a person convicted of attempted murder (Section 307 IPC) who claimed to be a juvenile at the time of the offence. After enquiry confirmed the petitioner was indeed a juvenile, the Court held that juvenile justice principles apply regardless of the serious nature of the crime. Rather than referral to a juvenile board, the Court exercised discretion to set aside the conviction sentence and instead directed the petitioner to plant 100 trees as community service within one year, finding this served the ends of justice.
