State Bank of India & Ors vs B.R. Saini

Bench: 2 — L. Nageswara Rao

In Brief

A bank officer was removed from service after disciplinary proceedings found him guilty of various charges including fraudulent loan transactions and unauthorised use of account powers. The High Court had set aside the removal order, holding that a second show-cause notice was required before imposing the penalty. The Supreme Court held that while natural justice requires an opportunity to respond to disciplinary charges, there is no legal requirement for a second show-cause notice when the employee has already received and responded to the inquiry report and the disciplinary authority's reasons for disagreement. The Court allowed the appeal and restored the removal order."
