Three temporary employees appointed as Clerk-cum-Accountant under an Adult Education Scheme in 1983 were terminated in 1992, then re-employed and terminated again in 2001. A High Court judgment set aside their terminations based on another case (Krishnanand Singh), but that case involved an employee appointed through public service commission selection, not a project scheme. The Supreme Court held that the High Court erred by not distinguishing this critical factual difference and set aside those orders. However, since the employees were already paid back wages and are now retired with pensions, no recovery was ordered. The High Court was left to decide other reliefs for similarly situated employees on their own merits."
