The respondents were appointed as Clerk cum Accountant on temporary basis under a government scheme for adult education in 1983. After terminations and multiple re-employments following litigation, they were eventually absorbed in 2005-2006. The High Court had set aside the terminations relying on a case (Krishnanand Singh) involving BPSC-selected regular appointees. The Supreme Court allowed the appeals, holding that the cases were factually distinct—the respondents were scheme-based temporary appointees, not regularly recruited officials. While setting aside the High Court orders, the Court prohibited recovery of back wages already paid as the respondents were now superannuated and pensioned, leaving other relief to the High Court's discretion."
