The Supreme Court examined whether respondents charged with murder and criminal breach of trust (IPC sections) and atrocities against Scheduled Castes (SC/ST Act) could be discharged because the investigation into SC/ST Act offences was conducted by a sub-inspector rather than a Deputy Superintendent of Police as required by law. The Court held that while SC/ST Act investigations must comply with rank requirements, IPC offences can proceed separately when the investigating officer was competent under general criminal procedure law. The Court partly allowed the appeal, restricting the discharge order to SC/ST Act charges and permitting trial to continue for IPC offences.
