In this criminal appeal, the State challenged the High Court's acquittal of two accused in a case arising from an altercation between neighbouring groups over right of way. The trial court had convicted both respondents of culpable homicide and grievous hurt resulting in one death. The Supreme Court upheld the acquittal, finding that the prosecution failed to credibly explain injuries sustained by the accused, confined witness statements only to the complainant group's injuries, and suppressed material facts. Absent satisfactory explanation for accused injuries and given their claim of private defence, the conviction was unjustified.
