The Supreme Court considered whether a daily wage employee engaged as a registration clerk in Uttar Pradesh could claim regularization in government service. The respondent was initially engaged on a daily wage basis in 1991, his termination was later set aside by the High Court, but a Division Bench rejected his plea for regularization. The Court held that the respondent's status remained that of a daily wage employee with no vested right to regularization. However, since his services could not be terminated without proper legal procedure once reinstated, he was entitled to arrears of wages from the date he filed his writ petition, computed and payable within three months.
