The State of Uttar Pradesh engaged the respondent as a daily wage registration clerk in 1991 via a departmental selection committee. When he was terminated along with other daily wage workers, he challenged this in the High Court, which set aside the termination and directed consequential benefits, treating his appointment as regular. The Supreme Court held that despite the High Court's finding that the appointment did not breach recruitment rules, the documentary evidence (Selection Committee minutes) clearly showed he was only engaged as a daily wage employee, not on a regular basis. Therefore, he had no vested right to regularization but was entitled to arrears of wages as a daily wage employee from the date of his writ petition."
