The State of Uttar Pradesh challenged a High Court judgment that granted a retired employee (Vijay Shankar Dubey) the benefit of an enhanced pay scale announced in a Government order. The Supreme Court held that since Dubey was not covered by the prescribed Government order at the time of his service and had already retired before the amended pay scale was announced, he was not entitled to such benefits. The Court set aside the High Court's judgment and allowed the appeal.
