In Brief

A retired government officer of Uttar Pradesh sought enhanced pension based on an amended pay scale for Joint Director, Prosecution. The State had implemented a higher pay scale with effect from 01.04.2001 following a Committee recommendation based on CBI analogies, but the officer had already retired on 31.01.1997. The High Court allowed his claim by relying on judgments concerning other departments. The Supreme Court reversed this, holding that the State can fix rational cut-off dates when extending a new benefit for the first time and that the officer was not entitled to retrospective implementation dating to the Fifth Pay Commission's 1996 recommendations.
