Supreme Court of India 2017-01-02 remanded

State of Uttar Pradesh vs Jai Bir Singh

Bench: 7 — T.S. Thakur

In Brief

A seven-judge bench of the Supreme Court, headed by Chief Justice T.S. Thakur, considered whether consolidated civil appeals and special leave petitions arising from a reference order required adjudication by a larger bench. The Court found that the issues raised—particularly concerning doubts about the correctness of Bangalore Water Supply & Sewarage Board v. A. Rajappa and their wide constitutional implications—warranted constitution of a nine-judge bench. The Court accordingly remanded the matter to the Chief Justice for constitution of an appropriate nine-judge bench to determine the questions raised in the reference order."
