Subha Prasad Nandi Majumdar, a teacher with 16 years' experience in Assam and 14+ years at a West Bengal university, sought to benefit from a 2021 government notification raising the retirement age from 60 to 65 years for non-teaching staff with 10 years' continuous teaching experience in 'any State-aided University or College'. The university denied the benefit, arguing teaching experience must be from within West Bengal. The Supreme Court allowed the appeal, holding that 'any' in the notification does not restrict experience to West Bengal alone, and excluding employees based solely on geographic location of prior experience is arbitrary and violates equality rights. The Court set aside the denial and granted the appellant the extended retirement age with ₹50,000 in costs.
