Navin Chandra Dhoundiyal vs State of Uttarakhand and Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Navin Chandra Dhoundiyal and other teachers challenged their superannuation as principals of a University, arguing they should remain as substantive teachers beyond age 60. The Supreme Court held that superannuation as principal does not terminate the underlying teaching appointment. Absent formal amendments with proper notice, universities must follow the prevailing statutory interpretation. The Court allowed the appeals and granted the teachers continuation as re-employed teachers until the following June, with reinstatement and full back-pay where applicable.
