This criminal appeal addresses whether a conviction for murder should be downgraded to culpable homicide. The deceased died from head injuries inflicted by an iron rod. Medical evidence showed eight injuries on the body, with three on the head, including deep wounds, blood clots on the brain, and ruptured blood vessels. The Supreme Court held that these injuries, their location on vital areas, the weapon used, and the force applied clearly demonstrated the accused's intention to cause death. Accordingly, the Court restored the conviction under Section 302 (murder) instead of Section 304 Part I (culpable homicide) and sentenced the accused to life imprisonment with a fine.
