This case involved a violent altercation between neighbours that resulted in the death of Balwan Singh. Surender @ Monu, one of the accused, attacked the deceased with an iron rod on the head, inflicting three head injuries including a 22 cm wound on the right temporal region with blood vessels cut and profuse bleeding. The trial court convicted him of murder under Section 302 IPC with life imprisonment. The High Court reduced this to culpable homicide not amounting to murder under Section 304 Part-I IPC with 10 years imprisonment. The Supreme Court allowed the appeal, holding that the medical evidence clearly established the accused's intention to commit murder, and accordingly restored the conviction to Section 302 IPC with life imprisonment and a fine of Rs. 2,00,000.
